NES SEEKS CLARITY AND GUIDANCE FROM COURTS IN ONE TOUCH MAKE READY ORDINANCE

Since the enactment of One Touch Make Ready, Nashville Electric Service (NES) has been in the impossible position of complying with the ordinance or its prior contracts. Today, NES filed a request for declaratory relief with the Davidson County Chancery Court seeking clarity and direction.

Because AT&T and Comcast have filed separate lawsuits against the Mayor and Metro Nashville, it has become clear to NES that if it chooses to comply with the ordinance, it will be subject to similar lawsuits.

“It is in the best interest of our customers and the citizens of Nashville to avoid protracted and costly litigation,” said NES President and CEO Decosta Jenkins. “We look forward to resolving this issue as quickly and efficiently as possible.”
